The first photos have surfaced showing Larry Birkhead with his daughter, Dannielynn.


OK! has the exclusive shots and an interview with the photographer, who last week was determined to be the biological father of the 7-month-old. TMZ are reporting that all the proceeds from the photo's are going into a trust for Dannielynn - wow that's actually a good idea, can you imagine Howard K Stern or Virgie doing that??

Larry Birkhead is the father of Anna Nicole Smith's baby daughter, Dannielynn, a Bahamian judge ruled Tuesday.


Birkhead said outside the court

"Everybody, I hate to be the one to tell you this -- but I told you so,"

When asked what's next, he said,

"I'm going to the toy store."

Crowds applauded in front of the courthouse as Birkhead, Smith's former boyfriend, made the announcement. Birkhead teared up as he thanked his supporters. A DNA test confirmed him as the father with 99.99 percent certainty, said Dr. Michael Baird, who performed the test.


The court had ordered DNA testing to determine the father of the child, who has been at the center of a paternity dispute since she was born in a Bahamian hospital in September. The doctor who performed a DNA test for Birkhead revealed the results to a closed session of a Bahamian court Tuesday.


Smith had publicly identified Howard K. Stern, her lawyer and live-in companion, as the baby's father and listed him as the father on the child's birth certificate. Stern hugged Birkhead and said he is not going to fight him for custody.


Stern said

"I'm going to do whatever I can to make sure he gets sole custody,"

When asked when Birkhead would get custody of the 7-month-old girl, who has been living with Stern in Nassau, Stern said he wanted there to be a "gradual transition." He said Birkhead could come to the house any time and spend as much time as he wants with his daughter.


Virgie Arthur, Smith's estranged mother who lives in Texas, said she was happy with the outcome. "All I care about is the safety and well-being of my little granddaughter," she said.


Another hearing is set for Friday to discuss the custody issue, which involves Stern, Birkhead and Arthur. It was unclear how Tuesday's news might affect that.

People are reporting that Anna Nicole Smith died of "an accidental overdose with no other criminal element present," Seminole Police Department Chief Charlie Tiger announced at a press conference in Ft. Lauderdale, Fla., Monday.


He said the police conducted a thorough investigation, which included reviewing hundreds of hours of videotapes captured by the hotel security cameras and analyzing the contents of the laptop computer belonging to Smith's companion, Howard K. Stern, and "we found nothing to indicate any foul play."


Broward County medical examiner Dr. Joshua Perper, who earlier had declined to make the autopsy results public until he reviewed the evidence, said that Smith's system contained methadone, anti-anxiety and weight-reducing drugs and, possibly, vitamins, among other substances.

Anna Nicole fended off Larry's court orders for a DNA test, but now she's passed away it's rumoured Howard is willing to hand Dannielynn over to Larry in exchange for a portion of her estate.


While Howard is listed as the girl's father on the birth certificate, insiders say that, during a recent meeting with Larry, he confessed he's not the dad. While Anna Nicole fought to keep Larry away from Dannielynn while she was alive, Howard let his former lover's rival meet the baby recently.


In exchange for giving Dannielynn to Larry, insiders say Howard wants ongoing control of Anna Nicole's estate. Once all the issues surrounding the estate have been settled, he also wants to become Dannielynn's trustee.


It's unknown how much money Anna Nicole had when she died, but the star had recently won the right to contest more than $600 million from the estate of her late husband J. Howard Marshall II, an oil billionaire who died in 1995 without writing Anna Nicole into his will.


Howard, who's admitted he was financially dependent on Anna Nicole, is also rumoured to be claiming the Bahamas house and the boat the star bought shortly before her death.


It's all about the money then Howard!

Anna Nicole Smith will be remembered Friday in the Bahamas.


Patrik Simpson, a friend of Smith who is helping to organize the memorial, told the Associated Press on Wednesday

"It will be a very beautiful Anna Nicole send-off. Of course it will be over the top because it's Anna Nicole."

About 300 guests will attend the service at a church filled with pink flowers and a well-known but as-yet undisclosed singer will perform, Simpson said.


Simpson's partner, Pol Atteu, who designed more than a dozen dresses for Smith, created the custom gown in which she will be buried in a "very elegant" casket, Simpson added.


Only about 30 people will attend the more private burial at Lakeview Memorial Gardens & Mausoleums, he said.
