Anna Nicole Smith's ex-boyfriend has launched a legal battle to try and
prove he is the father of her newborn daughter.

Photojournalist Larry Birkhead filed papers on Monday demanding that she return to California with baby Dannie Lynn who he claims is his.

The legal fight comes a week after her lawyer, Howard K. Stern, said he was the child's father - claims Birkhead has dismissed as "laughable".

Birkhead said

"I am not surprised he would say this but I am laughing at
it.

There is absolutely no way that Stern is the father of this child. He knows
it, I know it and that's all there is to it."

Birkhead is also seeking legal and physical custody of Dannie Lynn.

In a statement, his legal spokeswoman Debra Opri said

"The public will be
very surprised when they learn the details of the lifestyle this baby is
going to be faced with if she remains in the current situation."
